Forest Cooling Limited – Terms and Conditions

These Terms and Conditions apply to the supply and installation of air conditioning systems by Forest Cooling Limited, a company registered in England and Wales with registered address at 2 The Saplings, Holbury, SO45 2QP ("we", "us", "our"). By accepting a quotation or placing an order, you ("you", "your", "the Customer") agree to be bound by the terms set out below.

1. Definitions

  • "Goods" means the air conditioning equipment and any associated parts supplied by us.

  • "Services" means the installation and related works provided by us.

  • "Contract" means the agreement between you and us for the supply and installation of the Goods and Services.

2. Quotations & Orders

  • All quotations are valid for 30 days from the date issued unless stated otherwise.

  • A Contract is formed once you accept our quotation in writing (including by email or electronic signature).

  • Any changes to the specification or scope of work after acceptance may result in a revised quotation.

3. Pricing & Payment

  • All prices are quoted in pounds sterling and include VAT unless stated otherwise.

  • A deposit of 50% will be required at the time of booking, with the balance due immediately upon completion of the work.

  • Payment is accepted via bank transfer, debit card, or other agreed method.

  • Late payments may incur interest in accordance with the Late Payment of Commercial Debts (Interest) Act 1998.

4. Delivery & Installation

  • We will agree a mutually convenient installation date with you, although this may be subject to change due to factors outside our control.

  • You must ensure we have clear and safe access to the property and the area where the system is to be installed.

  • Any preparatory works (e.g. moving furniture, electrical modifications, or asbestos removal) are your responsibility unless otherwise agreed in writing.

  • Additional charges may apply if we are delayed due to lack of access or other unforeseen site issues.

5. Guarantees & Warranty

  • All equipment is supplied with the manufacturer’s warranty, typically ranging from 1 to 5 years, subject to proper use and regular servicing.

  • Our installation work is guaranteed for a period of 12 months from the completion date.

  • The guarantee does not cover damage caused by misuse, tampering, lack of maintenance, or accidental damage.

6. Customer Responsibilities

  • You are responsible for ensuring any necessary permissions (e.g. from a landlord, building management, or planning authority) are in place before installation.

  • You must inform us of any known hazards at the property, including asbestos, structural defects, or electrical issues.

7. Liability

  • We are not liable for any indirect or consequential loss, including loss of enjoyment, inconvenience, or wasted time.

  • Our total liability is limited to the price paid by you under the Contract.

  • Nothing in these Terms limits our liability for death or personal injury caused by negligence or for any other liability that cannot be excluded by law.

8. Cancellations & Refunds

  • You have the right to cancel the Contract within 14 days of accepting the quotation, provided no work has begun. This is in accordance with the Consumer Contracts Regulations 2013.

  • If you cancel after work has started, you will be liable for reasonable costs incurred up to the date of cancellation.

  • We reserve the right to cancel the Contract if we are unable to carry out the work due to safety concerns or other unforeseen site conditions.

9. Force Majeure

  • We shall not be liable for delays or failure to perform due to events beyond our reasonable control, including extreme weather, equipment failure, strikes, or other force majeure events.

10. Governing Law

  • These Terms and Conditions shall be governed by and interpreted in accordance with the laws of England and Wales.

  • Any disputes arising in connection with these Terms shall be subject to the exclusive jurisdiction of the English courts.
